Terms of Service

Welcome to Lawn Master Idaho. By using our services, you agree to these Terms of Service. Please read them carefully.

1. Service Agreement

When you subscribe to our lawn care services or request individual services, you enter into a service agreement with Lawn Master Idaho. This agreement covers the services selected, pricing, and service schedule.

2. Subscription Services

2.1 Monthly Subscription

Our residential subscription is billed monthly at the rate specified at signup. The subscription includes the services listed on our residential services page at the time of subscription, including weekly lawn mowing (approximately 28-32 visits annually, weather dependent), 7 professional fertilization treatments, weed control, grub prevention, annual sprinkler blowout and startup, annual spider barrier application, and up to 3 snow removals per season.

2.2 Initial Commitment Term

Our subscription requires a 12-month initial commitment beginning on your service start date. This commitment allows us to provide consistent, year-round care at an affordable monthly rate. After the initial 12-month term, your subscription will automatically renew on a month-to-month basis.

2.3 Automatic Renewal

Your subscription will automatically renew at the end of the initial term and each subsequent renewal period unless you provide written notice of non-renewal at least 30 days before the end of the current term. You may submit non-renewal notice via email to [email protected] or by calling (208) 504-0843.

2.4 Early Termination

If you wish to cancel your subscription before the end of the initial 12-month term, you must provide 90 days written notice and pay an early termination fee equal to 50% of the remaining monthly payments in your initial term. This fee compensates for the discounted pricing provided under the annual commitment.

Early Termination Fee Exceptions: The early termination fee will be waived in the following circumstances with appropriate documentation:

  • Military transfer with official orders
  • Sale of the service property (with proof of sale)
  • Documented unemployment
  • Serious illness or disability preventing property maintenance

2.5 Service Schedule

Weekly lawn mowing is provided during the growing season (typically April through October, weather dependent). The estimated 28-32 annual mowing visits is based on typical Idaho weather conditions and may vary due to seasonal factors. Fertilization treatments are scheduled throughout the year at optimal times for lawn health. Sprinkler services are performed in spring and fall. Snow removal is provided for accumulations greater than 1/2 inch, up to 3 times per season.

3. Payment Terms

3.1 Billing

Your first monthly payment is due upon subscription. Subsequent payments are billed on the 1st of each month. We accept major credit cards (Visa, Mastercard, American Express). Failed payments will be retried automatically.

3.2 Late Payments

Payments not received within 7 days of the due date will incur a late fee of 1.5% per month (18% annually) on the outstanding balance. Accounts with balances outstanding more than 30 days may have services suspended until payment is received. Suspended services do not extend or reduce your commitment term.

3.3 Price Changes

Subscription prices are locked for the duration of your initial 12-month term. Price changes for renewal terms will be communicated at least 30 days before your renewal date.

4. Property Access

You agree to provide reasonable access to your property for scheduled services. If we cannot access your property (locked gates, aggressive animals, etc.), the visit may be skipped without credit. Please notify us of any access issues in advance.

5. Weather and Rescheduling

Service may be delayed or rescheduled due to inclement weather, including rain, extreme heat, or other unsafe conditions. We will make reasonable efforts to reschedule within 24-48 hours. Weather delays do not result in credits or refunds.

6. Property Damage and Insurance

Lawn Master Idaho carries comprehensive general liability insurance with limits of $1,000,000 per occurrence and $2,000,000 aggregate. In the unlikely event of property damage caused by our crew, please notify us within 48 hours. We will investigate and address legitimate claims promptly.

We are not responsible for:

  • Damage to items left in the lawn (toys, hoses, decorations, etc.)
  • Underground utilities, irrigation lines, or cables not properly marked
  • Pre-existing conditions or damage
  • Damage caused by weather events during or after service
  • Damage resulting from customer instructions that conflict with best practices

7. Service Standards and Satisfaction

7.1 Service Commitment

Our services are performed according to professional lawn care industry standards. While we cannot guarantee specific results (as lawn health depends on many factors including watering, soil conditions, and prior care), we are committed to providing consistent, professional service.

7.2 Satisfaction Policy

If you are not satisfied with any service visit, please contact us within 48 hours. We will assess the concern and, at our discretion, either:

  • Re-perform the service at no additional charge
  • Apply a credit toward future services
  • Adjust our approach for future visits

This satisfaction policy applies to individual service visits and does not constitute a guarantee of specific lawn health outcomes or results.

8. Intellectual Property

8.1 Our Content

All content on the Lawn Master Idaho website, including but not limited to text, graphics, logos, images, photographs, videos, and software, is the property of Lawn Master Idaho or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from our website without our prior written consent, except for:

  • Temporary storage in your web browser cache for personal viewing
  • Printing pages for personal, non-commercial use
  • Sharing links to our website on social media

8.2 Trademarks

The Lawn Master Idaho name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Lawn Master Idaho. You may not use these marks without our prior written permission.

8.3 Customer-Submitted Content

If you submit content to us, including but not limited to reviews, testimonials, photographs of your property, or feedback (collectively, "User Content"), you grant Lawn Master Idaho a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You represent and warrant that:

  • You own or control all rights to the User Content you submit
  • The User Content is accurate and not misleading
  • The User Content does not violate any law or infringe any third party's rights
  • You have obtained any necessary permissions from individuals appearing in photographs

8.4 Feedback

Any feedback, suggestions, or ideas you provide to us regarding our services or website become our property. We may use such feedback for any purpose without compensation or attribution to you.

9. Communication

9.1 General Communications

By subscribing to our services, you consent to receive service-related communications via email, text message, or phone. This includes service confirmations, scheduling updates, and account notifications.

9.2 SMS/Text Message Consent

By providing your mobile phone number and agreeing to receive text messages, you expressly consent to receive recurring automated SMS/text messages from Lawn Master Idaho at the phone number you provided. These messages may include:

  • Service appointment confirmations and reminders
  • Crew arrival and service completion notifications
  • Weather-related schedule changes
  • Account and billing notifications
  • Promotional offers (if you have opted in to marketing)

9.3 Message Frequency and Rates

Message frequency varies based on your service schedule. You may receive approximately 2-8 service-related messages per month during the active service season. Message and data rates may apply. Check with your mobile carrier for details about your plan.

9.4 Consent Not Required

Consent to receive text messages is not a condition of purchasing our services. You may decline text messaging and still subscribe to our lawn care services. If you prefer not to receive text messages, please indicate this preference when signing up or contact us to update your communication preferences.

9.5 Opting Out of Text Messages

You may opt out of text messages at any time by:

  • Replying STOP to any text message from Lawn Master Idaho
  • Calling us at (208) 504-0843
  • Emailing us at [email protected]

After opting out, you will receive a one-time confirmation message. Opting out of text messages will not affect your service or other communications. You may opt back in at any time by texting START to our number or contacting us.

9.6 Marketing Communications

You may opt out of marketing communications (promotional emails, special offers) at any time by clicking the "unsubscribe" link in any marketing email or by contacting us. Opting out of marketing will not affect transactional communications related to your service.

10. Dispute Resolution and Arbitration

10.1 Informal Resolution

We encourage you to contact us directly with any concerns. Most issues can be resolved informally through good faith discussion. Please contact us at [email protected] or (208) 504-0843 before initiating formal proceedings.

10.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Ada County, Idaho.

10.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Lawn Master Idaho.

10.4 Arbitration Costs

Each party shall bear its own costs for arbitration, including attorney's fees. The arbitrator's fees and administrative costs shall be shared equally, except that Lawn Master Idaho will pay all fees for claims under $10,000 where you cannot afford to pay.

10.5 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

10.6 Opt-Out

You may opt out of the arbitration and class action waiver provisions by sending written notice to [email protected] within 30 days of first subscribing to our services. Your opt-out will not affect any other provisions of these Terms.

11. Limitation of Liability

Lawn Master Idaho's total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you paid for services in the previous 12 months. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

12. Force Majeure

Lawn Master Idaho shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, severe weather events, fire, flood, pandemic, epidemic, government actions, civil unrest, labor disputes, supply chain disruptions, or utility failures. In such events, our obligations will be suspended for the duration of the force majeure event.

13. General Provisions

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Ada County, Idaho.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Lawn Master Idaho.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Lawn Master Idaho may assign these Terms or any rights hereunder without restriction, including in connection with a merger, acquisition, or sale of assets.

13.5 Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Lawn Master Idaho regarding our services. These Terms supersede any prior agreements or understandings, whether written or oral.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms. If you do not agree to the updated terms, you may cancel your subscription in accordance with Section 2.
